1. About SONARIX

SONARIX is a Swiss sonic creation business operated by Gabriel Mermoud.

SONARIX provides services including sonic identity, audio logos, musical branding, sound design, custom music composition, audio production and other related creative services.

SONARIX is currently not subject to Swiss value-added tax (VAT).

2. Scope of These Terms

These Terms of Service govern access to and use of the SONARIX website, its content, contact forms and any other functionality made available through the website.

By accessing or using the website, you acknowledge that you have read, understood and agreed to these Terms and the SONARIX Privacy Policy.

If you do not agree with these Terms, you must not use the website.

When accessing the website on behalf of a company or another legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Relationship With Service Agreements

The information presented on the website is provided for general informational and promotional purposes and does not constitute a binding commercial offer.

Submitting a contact form, requesting information, scheduling a meeting or discussing a potential project does not automatically create a contractual relationship between SONARIX and the prospective Client.

Paid creative services are governed by:

  • the quotation accepted by the Client;

  • the applicable General Terms and Conditions of Sale;

  • any licence agreement, statement of work or additional written agreement relating to the project.

Where a conflict exists between these Terms and an accepted quotation or specific written agreement, the quotation or specific agreement shall prevail with respect to the relevant service.

4. Description of Services

SONARIX may present information concerning its creative services, previous projects, working methods, packages, estimated prices and availability through the website.

Descriptions, examples, prices, timelines and other information displayed on the website are indicative and may be changed, updated or withdrawn at any time.

Each project is subject to an individual assessment and, where applicable, a written quotation defining its scope, deliverables, price, timeline, revision allowance and usage rights.

SONARIX does not guarantee that every service presented on the website will remain available at all times.

5. Website Use

You agree to use the website only for lawful purposes and in a manner that does not interfere with its proper operation, security or accessibility.

You must not:

  • attempt to gain unauthorised access to the website, its servers or connected systems;

  • introduce malware, viruses, harmful code or disruptive technologies;

  • interfere with the website’s security or functionality;

  • impersonate another person or organisation;

  • you have the necessary rights and permissions to provide the materials;

  • the materials do not contain unlawful, harmful or malicious content.

You remain responsible for all materials that you submit.

Submission of materials through the website does not transfer ownership of those materials to SONARIX. However, you authorise SONARIX to access and review them to respond to your request, evaluate the proposed project and provide the requested services.

Any broader use of Client materials will be governed by the applicable quotation, contract or written agreement.

7. Intellectual Property

Unless otherwise indicated, the website and all content made available through it are owned by or licensed to SONARIX.

This includes, without limitation:

  • the SONARIX name and visual identity;

  • logos and branding elements;

  • website text and copy;

  • graphics, layouts and designs;

  • photographs and videos;

  • audio examples, music and sound effects;

  • project presentations and case studies;

  • downloadable documents;

  • the structure and organisation of the website.

Access to the website does not grant you any ownership rights or licence to use this content beyond normal personal or internal business consultation.

You may not reproduce, distribute, modify, publish, sell, licence, publicly perform, make available or commercially exploit any website content without prior written permission from SONARIX or the relevant rights holder.

Rights relating to creations produced for a Client are governed separately by the accepted quotation, the General Terms and Conditions of Sale and any applicable licence or intellectual property agreement.

8. Portfolio and Third-Party Content

The website may feature projects, brands, recordings, images, trademarks or other materials belonging to Clients, collaborators or third parties.

Such materials remain the property of their respective rights holders and are displayed solely to present SONARIX’s professional work, where authorised.

No rights to third-party brands or materials are granted through their appearance on the website.

9. Third-Party Websites and Services

The website may contain links to or integrations with third-party websites and services, including social networks, video platforms, audio platforms, scheduling services, payment providers or analytics tools.

These third-party services operate under their own terms and privacy policies.

SONARIX does not control and is not responsible for the content, availability, security, practices or policies of third-party services.

Accessing a third-party website or service is done at your own discretion.

Liability relating to paid creative services is governed by the applicable quotation, General Terms and Conditions of Sale and any specific written agreement concluded with the Client.

SONARIX processes personal data in accordance with applicable Swiss data protection law and the SONARIX Privacy Policy.

Personal data may be collected when you:

  • visit the website;

  • submit a contact form;

  • contact SONARIX by email;

  • request a quotation;

  • arrange a meeting;

  • provide information relating to a potential or active project.

13. Suspension and Termination

SONARIX may suspend, restrict or terminate access to the website where a user:

  • violates these Terms;

Termination of access does not affect rights or obligations that arose before termination.

Subject to any mandatory legal provisions protecting consumers or establishing another compulsory place of jurisdiction, any dispute arising from these Terms or the use of the website shall be submitted to the competent courts of Sion, Canton of Valais, Switzerland.
